Judge denies motion to dismiss City of Eagle’s lawsuit against Eagle Water Company

The Ada County District Court issued its decision today denying the Motion to Dismiss the City of Eagle’s Complaint, filed last February against Eagle Water Company. The City filed suit to enforce its Right of First Refusal to purchase the water system owned and controlled by Eagle Water. The Court soundly rejected arguments made by Eagle Water, and joined by Suez, that the Right of First Refusal was not enforceable based on the statute of frauds. The lawsuit will now go forward, assuming Eagle Water continues its refusal to honor its obligations under the Right of First Refusal. The City will continue to vigorously pursue the opportunity provided by the Right of First Refusal to purchase Eagle Water, ultimately allowing our citizens the vote to make that happen. This is a significant step forward for the City of Eagle and its citizens. We will keep you advised of future developments in the lawsuit.
