Fences and Retaining Walls

COMMERCIAL FENCES & RETAINING WALLS

Step 1:

Design Review approval is required for ALL commercial fences and retaining walls, regardless of height, and shall be submitted to the Planning and Zoning Department for approval as part of their Design Review Application submittal for the project.  Fences not requiring a building permit as listed in Step 2 may begin construction once the Design Review process has been completed and you have received authorization from the Planning and Zoning Department to proceed. 

Step 2:  

Building permits are required for commercial Fences > 7' High  & Retaining Walls > 4' in height measured from the bottom of the footing to the top of the wall, or supporting a surcharge or impounding Class I, II or IIIA liquids.  Permits shall be submitted once the applicant has been approved through the Design Review process and has received a zoning certificate from the Planning and Zoning Department. 

RESIDENTIAL FENCES & RETAINING WALLS (Front yard area and/or along any street)

Step 1:

Residential Fences & Retaining Walls, regardless of height, in any front yard area or along any street, shall first obtain a Fence Permit from the Planning and Zoning Department by submitting a completed Fence Permit Application.  Design Review is not required. Once the fence permit application has been approved, the Planning and Zoning Department will issue a permit and construction may begin, UNLESS the fence is >6' in height or the retaining wall is >4' in height measured from the bottom of the footing to the top of the wall , or if supporting a surcharge, in which case a building permit is also required and the applicant should proceed to Step 2 below.  

Step 2: 

Proceed with this step ONLY if the fence is >6' in height or the retaining wall is >4' in height measured from the bottom of the footing to the top of the wall, or is supporting a surcharge.

Once a fence permit has been approved by the Planning and Zoning Department, any Residential Fences > 6' in height per Eagle City Code 7-1A-4 IRC, & Retaining Walls > 4' in height measured from the bottom of the footing to the top of the wall, or supporting a surcharge shall obtain a building permit from the Building Department prior to start of construction. 

RESIDENTIAL FENCES & RETAINING WALLS (Common Lots)

Step 1:

Design Review approval is required for ALL common lot residential fences and retaining walls, regardless of height, and shall be submitted to the Planning and Zoning Department for review and approval.  

Step 2:

  1. Residential common lot fences > 6' in height & retaining walls > 4' in height measured from the bottom of the footing to the top of the wall, or supporting a surcharge shall submit a Building Permit application to the Building Department once Design Review approval has been received and a Zoning Certificate has been issued by the Planning and Zoning Department. Please have a copy of your zoning certificate approval as part of your building permit submission package. Construction shall not commence until the building permit has been issued.   Fences less than 6' in height or retaining walls less than 4' in height and not supporting a surcharge may skip this step (2-A) and proceed to step (2-B) below.
  2. Residential common lot fences 7' in height or less & retaining walls 4' in height or less, measured from the bottom of the footing to the top of the wall, and not supporting a surcharge, shall proceed once Design Review approval has been received and the applicant has been notified construction may commence.

All Other Residential Fences & Retaining Walls 

Step 1:

All other residential fences not listed above, that are > 6 ' in height & retaining walls > 4' in height measured from the bottom of the footing to the top of the wall, or supporting a surcharge shall obtain a building permit from the Building Department prior to start of construction. Design Review is not required.  

All other residential fences not listed above that are < 6' in height or retaining walls less than 4' in height and not supporting a surcharge do not require a building permit or design review approval, but must comply with Eagle City Code 8-3-3.
